Welcome to crispinsdiner.com (the “Site“). The Site is operated by Crispin’s Hell’s Kitchen LLC, d/b/a Crispin’s Diner (“Crispin’s,” “we,” “us,” or “our“). These Terms of Use (“Terms“) govern your use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:
- Use the Site in any way that violates applicable law or regulation
- Attempt to interfere with the proper working of the Site, including by introducing viruses, malware, or other harmful code
- Attempt to gain unauthorized access to the Site, its servers, or any related systems
- Use automated means (such as bots or scrapers) to access the Site without our prior written permission
- Impersonate any person or misrepresent your affiliation with any person or entity
- Harass, threaten, or abuse any other user or our staff
- Submit false, misleading, or fraudulent information through any Site form
2. Intellectual Property
The Site and all of its contents including text, graphics, logos, images, menus, photos, and the “Crispin’s Diner” name and logo, are all owned by Crispin’s Hell’s Kitchen LLC or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may view, download, and print pages from the Site for your personal, non-commercial use only. You may not otherwise reproduce, modify, distribute, transmit, republish, or exploit any content from the Site without our prior written permission.
3. Reservations
Reservations made through the Site are requests to dine at Crispin’s on the date and time you select. Submitting a reservation request does not guarantee a table; we will confirm your reservation separately by phone, email, or through our reservation platform.
You agree to provide accurate information when requesting a reservation. If you need to cancel or modify a reservation, please contact us as soon as possible. We reserve the right to cancel reservations, refuse service, or ask guests to leave in accordance with applicable law and our internal policies (for example, for no-shows, disruptive behavior, or capacity issues).
Large-party and private-event reservations may be subject to additional terms, deposits, or cancellation policies, which we will communicate to you separately.
4. SMS Messaging Program
If you opt in to SMS messaging when submitting a reservation, you are enrolling in our reservation notifications program. This section describes how the program works.
Program name. Crispin’s Diner Reservation Notifications.
What we send. Reservation confirmations, reminders before your reservation time, and follow-up messages after your visit. Messages are transactional and related to your reservation. We do not send marketing or promotional messages through this program.
Message frequency. Message frequency varies. You can expect up to 3 messages per reservation.
Message and data rates. Message and data rates may apply. Charges depend on your mobile carrier and plan.
How to opt in. You opt in by checking the box labeled “Send me text reminders about my reservation” on our reservation form. Opting in is voluntary and is not required to make a reservation.
How to opt out. Reply “STOP” to any text message you receive from us to opt out of further messages. After you reply “STOP”, you will receive one final confirmation message and no further messages will be sent for that phone number.
How to get help. Reply “HELP” to any text message you receive from us, or contact us at reservations@crispinsdiner.com with questions about the SMS messaging program.
Carriers. Carriers are not liable for delayed or undelivered messages.
Eligibility. The program is available to customers in the United States with a mobile carrier that supports SMS messaging. You must be the account holder or have permission from the account holder of the mobile phone number you provide.
5. Third-Party Links and Services
The Site may link to or integrate with third-party websites, platforms, or services, for example, mapping services, social media platforms, and third-party reservation or ordering platforms. We do not control these third-party sites and services and are not responsible for their content, policies, or practices. Your use of any third-party site or service is subject to that provider’s terms and privacy policy.
6. Accuracy of Information
We try to keep the Site accurate and up to date including menu items, prices, hours, and other information. We do not guarantee that all information on the Site is current, complete, or error-free. Menu items, prices, and availability are subject to change without notice. Please contact us directly if you have questions about current offerings.
7. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, error-free, or secure.
We do not warrant that any information on the Site is accurate, complete, or current, or that any defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by law, in no event shall Crispin’s Hell’s Kitchen LLC, its members, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Crispin’s Hell’s Kitchen LLC and its members, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another party.
10. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version on this page and update the “Effective Date” above. Your continued use of the Site after changes take effect means you accept the updated Terms.
12. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
